Terms and Conditions

These terms and conditions govern your use of Creativeuostoree's services and website. By engaging with our services, you agree to be bound by these terms.

Service Agreement

All landscape design services provided by Creativeuostoree are subject to written agreements that specify project scope, timelines, and payment terms. Design concepts and proposals remain the intellectual property of Creativeuostoree until full payment is received and project completion is confirmed.

Project Scope and Modifications

Project scope is defined in the initial service agreement. Any modifications or additions to the original scope may result in additional fees and timeline adjustments. Clients will be notified of any changes before work proceeds.

Payment Terms

Payment schedules are established in the service agreement. Payments are typically structured in phases corresponding to project milestones. Late payments may result in project delays or suspension of services.

Property Access and Permits

Clients are responsible for ensuring Creativeuostoree has appropriate access to the property for design consultation, site analysis, and implementation oversight. Clients are also responsible for obtaining any required permits or approvals from local authorities.

Warranty and Maintenance

Creativeuostoree provides guidance on plant establishment and landscape care. However, long-term maintenance and plant health depend on proper care, watering, and seasonal attention. We provide maintenance schedules but are not responsible for ongoing maintenance unless specifically contracted.

Limitation of Liability

Creativeuostoree's liability is limited to the value of services provided. We are not responsible for damage to existing structures, utilities, or property that may occur during implementation, provided standard industry practices are followed.

Intellectual Property

All design concepts, drawings, plans, and specifications created by Creativeuostoree remain our intellectual property. Clients receive usage rights for their specific property but may not reproduce or use designs for other properties without written permission.

Changes to Terms

Creativeuostoree reserves the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.

Dispute Resolution

In the event of any dispute arising from these terms or our services, both parties agree to first attempt to resolve the matter through good faith negotiation. If resolution cannot be reached within thirty days, disputes may be subject to mediation before pursuing other legal remedies.

Governing Law

These terms are governed by the laws of the jurisdiction in which Creativeuostoree operates. Any legal proceedings related to these terms shall be conducted in the appropriate courts of that jurisdiction.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

Entire Agreement

These terms, together with any written service agreements, constitute the entire agreement between you and Creativeuostoree regarding the use of our services. Any prior agreements or understandings are superseded by these terms.

Force Majeure

Creativeuostoree shall not be liable for any failure or delay in performance under these terms which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, government action, or other causes which are beyond our reasonable control. In such circumstances, we will make reasonable efforts to minimize delays and complete services as soon as practicable.

Insurance and Indemnification

Creativeuostoree maintains professional liability insurance appropriate to our services. Clients agree to indemnify and hold harmless Creativeuostoree from any claims arising from client-provided information, client-directed modifications to designs, or client-managed implementation that deviates from our specifications.

Confidentiality

Both parties agree to maintain confidentiality regarding proprietary information shared during the course of the project. Creativeuostoree will not disclose client-specific project details without permission, except as required by law or for professional portfolio purposes with client approval.

Termination

Either party may terminate a service agreement with written notice. Upon termination, clients are responsible for payment of all services rendered up to the termination date. Creativeuostoree retains rights to all design work completed prior to termination.

Assignment

Clients may not assign or transfer their rights or obligations under these terms without written consent from Creativeuostoree. Creativeuostoree may assign our rights and obligations to qualified successors with appropriate notice to clients.

Waiver

Failure by either party to enforce any provision of these terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by the party granting the waiver.

Client Responsibilities

Clients are responsible for providing accurate and complete information about their property, including existing conditions, utilities, easements, and any known environmental concerns. Clients must disclose any restrictions, covenants, or homeowner association requirements that may affect the design or implementation. Failure to provide accurate information may result in design modifications and additional costs.

Clients are responsible for maintaining their property in a condition that allows safe access for site visits and implementation. This includes ensuring pathways are clear, utilities are marked, and any hazards are disclosed. Clients must also ensure that pets, children, or other occupants do not interfere with work activities during site visits or implementation.

Design Approval Process

Design concepts and plans require client approval before proceeding to implementation. Clients have a specified timeframe, typically 14 business days, to review and approve or request revisions to design documents. If no response is received within the approval period, designs are considered approved and work may proceed. Approval of design documents constitutes acceptance of the design approach and materials specified.

Once designs are approved, significant changes may require additional design work and fees. Minor adjustments can typically be accommodated during implementation, but structural changes, material substitutions, or scope modifications require written approval and may affect project timeline and cost.

Site Conditions and Limitations

Creativeuostoree conducts site analysis to identify existing conditions, but we cannot guarantee discovery of all subsurface conditions, utility locations, or hidden issues. If unexpected conditions are discovered during implementation that affect design feasibility or cost, we will notify clients immediately and provide options for addressing the conditions.

Soil conditions, drainage patterns, and microclimates may vary from initial assessments. While we design based on available information, actual site performance may differ from projections. We provide guidance on addressing site-specific challenges but cannot guarantee specific outcomes for plant performance or drainage behavior.

Professional Standards

Creativeuostoree adheres to professional standards and best practices in landscape design and implementation. We maintain appropriate professional credentials and continuing education. Our designs comply with applicable building codes, zoning regulations, and industry standards to the best of our knowledge.

However, clients are responsible for verifying that designs comply with all local regulations, building codes, and homeowner association requirements. We recommend that clients consult with local authorities and obtain necessary permits before beginning implementation.

Communication Protocols

Effective communication is essential for successful projects. We establish primary communication channels at project initiation and expect timely responses to project-related communications. Clients should designate a primary contact person for the project to ensure consistent communication and decision-making.

Regular project updates will be provided at key milestones. Clients are encouraged to raise questions or concerns promptly so they can be addressed efficiently. Delays in client communication or decision-making may affect project timelines and may result in schedule adjustments.

Record Keeping and Documentation

Creativeuostoree maintains project records including design documents, correspondence, change orders, and project photographs. Clients receive copies of all design documents and key project communications. We retain project records for a period specified in our service agreements, typically seven years, for reference and potential future work.

Clients are encouraged to maintain their own copies of all project documents. Original design drawings and specifications remain the property of Creativeuostoree, but clients receive usage rights for their specific property as outlined in the intellectual property section.

Subcontractors and Third-Party Services

For implementation services, Creativeuostoree may coordinate with qualified subcontractors including contractors, irrigation specialists, and plant suppliers. We select subcontractors based on qualifications and experience, but we are not responsible for subcontractor workmanship unless we are directly managing the installation.

If clients choose to use their own contractors for implementation, we provide design documents and specifications, but we are not responsible for implementation quality or contractor performance. Clients using their own contractors assume responsibility for ensuring work meets design specifications.

Environmental Compliance

Our designs prioritize environmental responsibility and sustainability. We comply with applicable environmental regulations and design practices that minimize environmental impact. However, clients are responsible for ensuring that implementation complies with all local environmental regulations, water use restrictions, and protected species requirements.

Some jurisdictions have specific requirements regarding water use, plant selection, or construction practices. Clients should verify compliance with all applicable environmental regulations before beginning implementation.

Limitations of Design Services

Landscape design services provide plans and specifications, but actual results depend on many factors including site conditions, implementation quality, maintenance practices, and environmental factors beyond our control. We design based on professional judgment and best practices, but cannot guarantee specific outcomes for plant growth, material performance, or landscape appearance.

Natural systems are inherently variable, and landscapes evolve over time. Our designs account for expected growth and change, but actual results may vary based on care, weather, and site-specific factors. We provide guidance on maintenance and care, but long-term landscape performance depends on proper ongoing maintenance.
